TEMPTATIONS Snacky Mouse Competition T&C’s

By participating in this competition advertised by MARS on its website, you confirm that you accept and agree to these competition terms (the “Competition”).

The promoter of the Competition is Mars New Zealand Limited (117682) of Building 14/666 Great South Road, Ellerslie 1051, Auckland, NZ (“the Promoter”).

This Competition is only open to Eligible Entrants. An “Eligible Entrant” is an individual who is: (i) a New Zealand resident; (ii) lives or has a postal address within New Zealand; (iii) aged 18 or over; and (iv) not an employee of Mars, its agents, affiliates, contractors, consultants, or their immediate family member or to other persons assisting with the Competition.

“Immediate family member” means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.

Entry into the Competition is open from 5:00pm, NZDT, Monday, 18 November 2024 to 5:00pm, NZDT, Monday, 8 December 2024 (“Campaign Period”)

The Competition will run online at temptationstreats.co.nz/competition. To enter the Competition, an Eligible Entrant must, during the Campaign Period, (a) visit the Temptations website at temptationstreats.co.nz/competition; and (b) complete the entry form, including selecting the tick box to consent to receive promotional and marketing materials from the Promoter. A maximum of one entry will be accepted per Eligible Entrant. Consenting to receive promotional and marketing materials from the Promoter is a condition of entry into the Competition.

The Promoter is not responsible or liable for any late entries or for any problems or technical malfunction which may result in delay or failure to enter into the Competition.

All information provided by an entrant is provided to the Promoter. Any queries, comments or complaints about this Competition must be directed to the Promoter.

This is a game of chance and skill plays no part in the determination of the winners. There will be one random draw conducted at the end of the Campaign Period. The winners will be drawn by the Promoter at 9:00 am NZDT on 10 December 2024 at the Promoter’s address. There will be 1,000 prize winners drawn randomly from an automated generator from the entries received during the Campaign Period (each a “Prize Winner” and collectively “the Prize Winners”). Each Prize Winner will receive one Prize. The Promoter may draw additional reserve entries in a draw and record them in order, in case a winning entry/entrant is deemed invalid (“Reserve Entrants”). The unclaimed Prize determination will take place on 14/01/2025 at the same location as the original draw to randomly distribute the Prize. The new Prize Winner/s will be notified by email within three business days of the Prize being re-drawn.

The Promoter accepts no responsibility or liability for the delivery of the Prize to the Prize Winner, or any Prize Winner’s enjoyment of any Prize or any other costs and expenses that may be incurred by the Prize Winners relating to the Prize or the Prize Winner’s enjoyment of that Prize. If the Prize or any portion of it becomes unavailable for reasons beyond the Promoter’s control, the Promoter reserves the right to substitute it for another Prize of at least equal retail value.

The Prize is 1 unit of a Snacky mouse cat toy (“the Prize”). There are 1,000 Prizes to be won. The Prize will be supplied by the Prize Provider in one shipment to the Prize Winner’s nominated delivery address within New Zealand, as provided at the time of signing up for the competition on the Temptations website.

The Promoter will notify the Prize Winners on 11 December 2024 via email (as submitted on their entry form). Entry into the Competition is deemed as consent for the Promoter to contact you as an entrant and to deliver the Prize to your address as nominated in your entry form.

Prizes cannot be transferred or exchanged or redeemed for cash. The Promoter takes no responsibility for entries or Prizes that are lost or destroyed.

Accepting the Prize constitutes a Prize Winner's consent to be photographed and/or interviewed by the Promoter and for the Promoter to use their name, city/town of residence, competition entry and/or photographs and interviews for Competition or publicity purposes without compensation or attribution of authorship. This includes on the Promoter’s website and social media platforms.

The decisions of the Promoter on all matters relating to this Competition are final and no correspondence will be entered into. The Promoter reserves the right to discard any entry it deems in its absolute discretion to contravene these terms and conditions. The Promoter may verify the validity of an entry or a Prize Winner's right to redeem the Prize in accordance with these terms and conditions. Where the Competition is not capable of operating as planned, the Promoter reserves the right, at its sole discretion, to amend, cancel, terminate, modify or suspend these terms and conditions and the Competition at any time and without prior notice.

To the extent permitted by law, the Promoter excludes any liability it may have to entrants arising directly or indirectly out of or in connection with the Competition.

The Competition is in no way sponsored, endorsed or administered by, or associated with any social media platform provider (including, but not limited to, the providers of Facebook, Instagram, TikTok and Twitter) or any of their related entities (Media Provider). Each entrant agrees to release any Media Provider from all liability in connection with, or in relation to, the Promotion. The terms and conditions of the Promotion do not intend to conflict with, or derogate from, a Media Provider’s terms and conditions of use, statement of rights and responsibilities (if any), data use policy or any other terms and conditions imposed by the relevant Provider on entrants from time to time to use the relevant social media platform.

Personal information provided by entrants will be collected and used by the Promoter for the purpose of conducting and administering the Competition and for the provision of marketing materials. Personal information of claimants will be stored on the Promoter’s database and the Promoter will use this information for future marketing purposes regarding its products, including contacting the claimant electronically. The Promoter is bound by the New Zealand Privacy Principles in accordance with the Privacy Act 2020 (NZ) and will handle personal information in accordance with its privacy policy which is located at www.mars.com/privacy. The Promoter may disclose the claimants’ personal information to third parties including its contractors and agents, prize suppliers and service providers to assist in conducting this Competition. If the claimant does not provide their personal information as requested, including providing consent to opt-in to receive marketing materials from the Promoter they may be ineligible to claim a prize in the Competition.
